As individuals get older, many are faced with difficult and important decisions regarding healthcare and our financial well-being. Some people require the care of a nursing home, but do not have the proper information in order to plan for the expenses of managed care or protect themselves from abuse and mismanagement. I can help you plan for both the present and the future through the use of: wills, trusts, powers of attorney, health care proxies, and Medicaid planning.
My firm handles a variety of estate planning matters, including planning for the distribution of an individual's property at his or her death and taking into account wills, taxes, insurance, property, and trusts, to gain the maximum benefit while carrying out the person's wishes. Our office handles numerous Probate cases and Medicaid Applications, so we are often able to adapt our documents to address issues that may arise later when the documents are submitted to the Court or Mass Health.
Probate is the legal process by which a person's debts are paid and assets are distributed upon her or his death. Estate Administration includes the probate process as well as non-probate transfers of the deceased's assets. Individual state laws direct the probate court how to distribute the deceased's estate. Recently, Massachusetts implemented the Uniform Probate Code which directs the process by which we submit a case to the Court. Our office has been handling these cases since day one of the new rules, so we are completely familiar with the system. Often, this allows us to navigate through the Court more expediently than others.
Our office handles Mass Health applications for all types of Mass Health. Community Mass Health provides coverage to clients who remain living in their homes, but still need services. Long-term Mass Health is for individuals who need the services of a nursing home. We are familiar with both types of Mass Health, and can often make a very stressful time much easier for clients.
I am accredited by the Veteran's Administration as an attorney authorized to help Veterans apply for benefits. We have been handling these cases since 2009 and have found ways to navigate this process. I have handled both Aid and Attendance claims as well as service related claims. One claim in particular resulted in the client being awarded a 100% disability rating and a retroactive payment of over $130,000.00. We are familiar with Agent Orange Claims as well as simple spousal aid and attendance claims. And are willing to evaluate any potential claim a client may have. I am often at the Veteran's Administration in Boston at least once a month to make sure my clients' cases get the attention they deserve.
